Topic: spanish law on surviving partners rights
User: DVD (view profile)1 Sep 2010 - 13:36
could any one help with a question regarding surviving partners rights.
we are looking to buy a park home in Antequeira, I am 60 and my husband is 65.  should one of us die does the property automatically revert to the surviving partner?

We understand that inheritence tax will have to be paid, the thing that is bothering both of us is we both have 2 daughters to previous marriages, all 4 have moved on and do not keep in contact, we know they are living in other countries.
will they have a right to part of the Park Home under the spanish law of inheritance.
If we are both dead they can fight it out amongst themselves but we need to know if the person left will have a home for the rest of their lives.

As I understand it, if you're both British you can basically state in your will that British inheritance law will apply.

You do need a will though, and it would be worth getting one in Spanish, and possibly even running it by a Spanish solicitor.
